Do I need a written contract to list my home with a real estate agent?

Yes. In Ontario, you must sign a Listing Agreement to formally authorize a brokerage to market and sell your property. This agreement includes the list price, commission rate, contract duration, and any additional terms. It's legally binding and must be signed before your home can be advertised on MLS or shown to buyers. Always read it carefully and ask your agent to explain anything unclear.

What are my legal obligations when selling a home in Ontario?

You’re legally required to disclose known material latent defects—these are problems that aren’t visible but could make the home unsafe or unfit for habitation (e.g., mold behind walls or structural issues). You’re not legally required to complete a seller property disclosure statement, but if you do, it must be accurate. Misrepresentation can lead to legal action—even after the sale.

Can I sell my home before my mortgage term is up?

Yes, but it could cost you. If you have a fixed-term mortgage, your lender may charge a prepayment penalty for breaking the contract early. This can range from a few thousand dollars to much more depending on your balance, rate, and time remaining. Always request a mortgage payout statement from your lender before listing to understand your numbers.

What happens if multiple buyers make an offer?

Your agent must present all offers fairly and explain each one, but you as the seller make the final decision. You can accept, reject, or counter any offer. If there are multiple offers, your agent may recommend holding an “offer review” at a set time. You don’t have to accept the highest price—you can weigh conditions, closing dates, and buyer financing too.

What’s included in a typical home sale closing process?

Once your offer is accepted and all conditions are met, your lawyer handles the legal paperwork. They’ll confirm title ownership, register the sale, pay out your mortgage from the proceeds, and coordinate with the buyer’s lawyer. You’ll also sign final documents, provide keys, and pay any closing costs like legal fees or outstanding utility bills.
